This penalty arises from a 2020 agreement aimed at resolving ongoing federal civil and criminal investigations.
Approval of the settlement could pave the way for Purdue to move forward with the resolution of thousands of lawsuits filed against it. However, the judge's endorsement would mean that other penalties could be waived as part of this settlement, effectively allowing Purdue to settle its other legal challenges.
Controversially, while Purdue itself has been fined, members of the Sackler family that controls the company remain shielded from many legal repercussions regarding the opioid epidemic. In 2021, a judge approved a plan where the Sacklers are required to pay up to $7 billion to state, local, and tribal governments over the next 15 years, an effort aimed at mitigating the damage done by their product.
Despite Purdue having been responsible for only a fraction of opioid prescriptions, their aggressive marketing strategies for OxyContin in the late 1990s and 2000s have been criticized as a key driver behind the addiction crisis. In a notable instance, Richard Sackler, once a prominent executive at Purdue, famously urged a sales force to create a “blizzard of prescriptions”.
As part of the larger agreement, Purdue Pharma is expected to dissolve and re-emerge as a new entity, Knoa Pharma, focused on public benefit rather than profit. This reorganization is regarded as one of the most complex in corporate history, with Purdue reportedly spending extensive resources on legal fees throughout this process.
Moreover, victims and families affected by opioid overdoses continue to push for more accountability from individual members of the Sackler family, arguing that financial settlements alone do not equate to justice. Recent years have seen a surge in pressures from these advocacy groups, who demand criminal charges against those responsible for the devastating impact of OxyContin.
