The European Court of Human Rights has found that Caster Semenya’s right to a fair hearing was infringed by the Swiss court following her appeal against World Athletics regulations.


This ruling represents a key moment in Semenya’s ongoing legal struggle against sex eligibility rules in athletics that have barred her from competing.


Caster Semenya, the renowned South African middle-distance runner and double Olympic champion, has achieved a significant legal victory as the European Court of Human Rights (ECHR) ruled that her right to a fair hearing was violated by the Swiss Federal Supreme Court. The ruling is a crucial milestone in Semenya's long-standing battle against World Athletics’ policies that restrict athletes with differences in sexual development (DSD) from competing unless they lower their testosterone levels.

The ECHR's verdict follows Semenya's 2020 loss, whereby she appealed against regulations imposed by World Athletics that effectively blocked her from competing in her signature event, the 800m. The court highlighted that the Swiss Supreme Court's actions did not align with Article 6 of the European Convention on Human Rights, which guarantees a fair hearing. The judges noted a “shortfall” in the necessary rigor that should have characterized the Swiss court's review.

At 34 years old, Semenya has been unable to compete in the 800m since the rules were enacted in 2019. These regulations specifically target athletes like her, who have elevated testosterone levels due to DSD conditions. She has consistently argued that these rules amount to discrimination against individuals with biological differences and infringe on their rights as athletes. Semenya expressed her relief following the ruling, emphasizing the broader implications: "It's about human rights. It's about the protection of the athletes," she stated, adding that she aims to give a voice to those who feel marginalized.

While the ECHR ruling validates Semenya’s claims regarding her right to a fair hearing, it does not dismantle the restrictions placed on DSD athletes nor does it directly alter existing regulations upheld by World Athletics. The ruling was specifically against the Swiss government for its failure to protect Semenya’s rights, leaving open the possibility for further legal avenues at the Swiss Federal Court in Lausanne.

Caster Semenya's attorney, Schona Jolly, remarked on the significance of the ruling, reaffirming the necessity for international sports governance to acknowledge and uphold athletes' fundamental rights. "It's not possible to put this aside and say 'the substantive rights of the athlete don't matter'," Jolly stated.

Despite this legal victory, the enforcement of World Athletics’ eligibility criteria remains intact, which has effectively put an end to Semenya’s competitive career. The organization's confidence in maintaining the current rules is based on research suggesting that athletes with conditions like Semenya's hold a distinct physiological advantage over their non-DSD counterparts.

As worldwide discussions on gender inclusion in sports continue, this ruling from the ECHR will likely lead to renewed examination of the fairness and implications of sex eligibility rules across various sports, particularly in light of the upcoming Paris 2024 Olympics.
