In brief

In a critical ruling, the Mexican Supreme Court has dismissed a challenge to recent judicial reforms that mandate the election of judges, sparing President Claudia Sheinbaum from a political conundrum while reinforcing her party's legislative victory.

On November 5, 2024, Mexico’s Supreme Court issued a pivotal ruling dismissing a proposal aimed at overturning key components of a significant judicial overhaul. This reform, recently ratified by the governing Morena party, drastically alters the country’s judiciary by requiring that judges be elected rather than appointed, a measure that is unprecedented among major nations. With this unanimous decision, the Supreme Court effectively resolves a heated contentious debate surrounding the restructuring of Mexico’s courts. It allows President Claudia Sheinbaum to sidestep the difficult choice of either complying with a potential court ruling against the overhaul or aligning with her party’s inclination to disregard such a decision. Justice Juan Luis González Alcántara had initially proposed a compromise that sought to maintain some degree of judicial independence by allowing elections for justices of the Supreme Court and other higher courts while preserving appointed roles for thousands of lower-level judges. The intention was to mitigate political strife, as González Alcántara emphasized the need for careful consideration on the matter.Despite his attempt at negotiation, the court required a minimum of eight votes to proceed with the proposal, which ultimately failed to secure the necessary support. The outcome signifies a considerable triumph for the Morena party, whose legislative push received approval in September as part of one of the most substantial judicial transformations seen in recent history.
