Unjust Delay: Young Girl's Ordeal in Federal Custody

McALLEN, Texas (AP) — For five months, a young father awaited his 3-year-old daughter’s release from federal custody after she and her mother crossed the U.S.-Mexico border, only to learn of the horrific abuse she faced in foster care.

The man, who is a legal permanent resident, sought help through the courts and discovered that his daughter had suffered alleged sexual abuse while under government care. “She was so long in there,” he lamented, highlighting the negligence that led to this tragedy. He spoke anonymously to protect his daughter’s identity as a victim.

Last year, following President Trump’s administration's new immigration policies, children like the man's daughter faced extended detention times. The changes aimed to tighten existing legal frameworks governing the care of immigrant children.

Various struggles ensued, including the father's inability to secure a fingerprint appointment for family reunification amid bureaucratic delays. Allegations revealed that an older child in the foster care facility had abused his daughter.

“I asked them, ‘What happened? I want to know,’” he recalled, frustrated with the lack of information. The girl's situation became known only after attorneys intervened, spurring the federal government to address his application for reunification.

During her time in foster care, the girl reported the abuse to a caregiver after signs of trauma were noticed. Federal officials referred to the incident vaguely as an “accident.” Following the father's legal inquiries, the girl underwent a forensic examination, leading to serious allegations being reported to local law enforcement.

Reflecting on the turmoil of separation and neglect, the child’s attorney, Lauren Fisher Flores, emphasized the gravity of such occurrences under government supervision: “To have your child abused while in the government’s care... it is unimaginable.”

The father finally reunited with his daughter in February after months of emotional strain. Upon seeing her again, he cried with joy, yet the emotional effects of detention lingered. “She was never like that before,” he observed, as the child now experienced nightmares and anxiety.

Currently living with family in Chicago, the father grapples with the reality of navigating the immigration court system for his daughter’s safety and future. This tragic case is a stark reminder of the dire consequences of prolonged detentions, reinforcing the need for urgent reforms in policies affecting immigrant families.
