The Famagusta criminal court cleared the defendants—aged between 19 and 20 and hailing from Majd al-Krum—of two counts of rape, sexual abuse, forced sexual intercourse, sexual harassment, and abduction.
The trial commenced in October 2023, stemming from claims made by the woman that she was sexually assaulted in September 2023. Central to the court's decision was the determination that the woman’s testimony lacked credibility, containing notable inconsistencies particularly regarding the identification of the accused and the events in question.
The court highlighted pivotal contradictions in her statements. It noted that her claim of being forcibly removed from a large party contradicted a friend's testimony who stated she saw her willingly ascend to a private room with another individual. Furthermore, while laboratory tests indicated that the woman had been drinking and using narcotics, the judges concluded that the effects were not severe enough to prevent her from consenting to sexual activity.
Witness testimony from individuals in adjacent rooms further supported the court's ruling, as they reported hearing no cries for help during the alleged incident. The judges remarked on notable shifts in the woman’s narrative, including various counts of the number of men involved over her multiple statements, which undermined her credibility.
Additionally, the court could not ascertain whether any abrasions on the woman’s body were from the encounter in question or possibly from consensual intercourse prior. Parts of the trial were conducted in private to preserve the sensitive nature of the case.
